The Fact of Section 49-O if Indian Constitution

These day another hoax mail is spreading with following text:

Section 49-O of the Conduct of Election Rules 1961.

Did you know that there is a system in our constitution, as per the 1969 act, in section "49-O" that a person can go to the polling booth, confirm his identity, get his finger marked and convey the presiding election officer that he doesn't want to vote anyone!Yes such a feature is available, but obviously these seemingly notorious leaders have never disclosed it. This is called "49-O". Why should you go and say "I VOTE NOBODY"...

Because, in a ward for example, if a candidate wins, say by 123 votes, and that particular ward has received "49-O" votes more than 123, then that polling will be cancelled and will have to be re-polled. Not only that, but the candidature of the contestants will be removed and they cannot contest the re-polling, since people had already expressed their decision on them. This would bring fear into parties and hence look for genuine candidates for their parties for election. This would change the way, of our whole political system...

It is seemingly surprising why the election commission has not revealed such a feature to the public....It Seems to be a wonderful weapon against corrupt parties in India...

Show your power, expressing your desire not to vote for anybody, is even more powerful than voting...

So don't miss your chance.

So either “VOTE”, or vote “NOT TO VOTE” (vote 49-O)
We, the people of India, can really use this power to save our nation।

I’ve gone thru it and find some Fact, which I’d like to share with you.

In Indian Constitution there is No any Section 49-O

The Said Section is Available with Indian Ministry of Law and Justice, THE CONDUCT OF ELECTIONS RULES, 1961 which says

“49-O. Elector deciding not to vote.-If an elector, after his electoral roll number has been duly entered in the register of voters in Form-17A and has put his signature or thumb impression thereon as required under sub-rule (1) of rule 49L, decided not to record his vote, a remark to this effect shall be made against the said entry in Form 17A by the presiding officer and the signature or thumb impression of the elector shall be obtained against such remark.”

क्या टीवी चैनल ऎसा नहीं कर सकते?

बात उस समय की है, जब पूर्व प्रधानमंत्री राजीव गांधी एक आत्मघाती हमले में मारे गए थे। प्रसिद्ध अमेरिकी पत्रिका “ टाइम” ने उस हादसे की तस्वीर प्रकाशित नहीं की। लेकिन अपने इस फैसले के बारे में एक संपादकीय जरूर प्रकाशित किया।

“टाइम” ने लिखा, बावजूद इसके, कि यह हादसा दुनिया पर असर डालने वाली घटनाओं में से एक था, बावजूद इसके, कि राजीव गांधी विश्व के एक प्रमुख नेता थे, उन्होंने संपादकीय मंडल के विचार-विमर्श के बाद उनकी मृत्यु की तस्वीर प्रकाशित नहीं करने का फैसला किया।

“टाइम” के संपादकीय में लिखा गया था, कि “वे तस्वीरें प्रकाशित नहीं करने का फैसला इसलिए किया गया कि मौत ने उन्हें वह गरिमा नहीं बख्शी जिसके वह हकदार थे। हम वे तस्वीरें नहीं प्रकाशित कर उनकी गरिमा की रक्षा करना चाहते थे।“

यह बात हम भारतीय समाचार टीवी चैनलों को याद दिला कर एक अनुरोध करना चाहते हैं, कम से कम लाशों की तसवीरें तो प्रसारित नहीं करिए।

बम विस्फोट हो, या चामुंडा मंदिर में भगदड़, या लखनऊ फ्लाईओवर के धंसने से उसके नीचे दबे मृत शरीर- उनकी तस्वीरें दिखा कर क्या आप किसी मृतक की गरिमा का अनादर नहीं कर रहे? क्या उनके शोकग्रस्त परिवारों के प्रति आप यत्र- तत्र बुरी हालत में पड़ी लाशों की तस्वीरें टीवी पर दिखा कर उस हादसे से भी ज्यादा क्रूरता नहीं बरतते?

कितने ही अखबारों ने भोपाल गैस कांड के बाद लाशों की वीभत्स तस्वीरें छपने से परहेज किया था। तस्वीरें छपीं जरूर, लेकिन प्रतीकात्मक।

हादसों की रिपोर्टिंग करते समय क्या टीवी चैनलों पर भी पत्रकारिता की इस गरिमामय परंपरा का पालन नहीं किया जा सकता?

विद्वता के साथ मनुष्य में विनम्रता भी होनी चाहिए।

महाकवि माघ राजा भोज के राज्य में रहते थे। उन्हें अपनी विद्वता का बड़ा घमंड था। एक बार वह राजा भोज के साथ जंगल में घूमने निकले। लौटते समय शाम हो गई। वे किसी आश्रय की तलाश करने लगे। तभी उन्हें एक झोपड़ी दिखाई दी, जिसके बाहर एक बुढ़िया बैठी थी। महाकवि माघ ने बुढ़िया से पूछा, 'यह रास्ता किधर जाता है?' वृद्धा ने एक क्षण रुककर कहा, 'रास्ता तो कहीं नहीं जाता। वह तो अपने स्थान पर स्थिर है, केवल यात्री आते-जाते हैं। परंतु तुम कौन हो?' माघ ने उत्तर दिया, 'हम यात्री हैं।' यह सुन वृद्धा मुस्कराई और बोली, 'यात्री तो दो ही होते हैं- सूर्य और चंद्रमा, तुम कौन हो?' महाकवि अचरज में पड़ गए और बोले, 'हम राजा हैं।' उन्होंने सोचा कि शायद इस उत्तर का बुढ़िया पर प्रभाव पडे़ और वह आगे प्रश्न न करे, पर वृद्धा बोली, 'नहीं! आप लोग राजा नहीं हो सकते, क्योंकि राजा तो दो ही हैं- एक इंद्र और दूसरा यम।' महाकवि विचलित हो उठे और बोले, 'हे मां, हम क्षणभंगुर मनुष्य हैं।' तब वृद्धा बोली, 'क्षणभंगुर भी दो ही होते हैं- पहला धन और दूसरा यौवन। पुराण कहते हैं कि इन दोनों पर विश्वास नहीं करना चाहिए।' वृद्धा की हाजिर जवाबी ने महाकवि को चक्कर में डाल दिया। वह बोले, 'हम सबको क्षमा करने वाली आत्मा हैं।' यह सुनकर वृद्धा मुस्कराई और बोली, 'इस संसार में सबको क्षमा करने वाली दो ही चीजें हैं- पृथ्वी और नारी। तुम इन दोनों की बराबरी कैसे कर सकते हो?' अब माघ ने हाथ जोड़कर कहा, 'मां, हम हार गए, अब तो रास्ता बताओ।' वह बोली, 'तुम हारे कहां हो? हारता तो वह है जिसने ऋण लिया हो या फिर जिसने चरित्र खो दिया हो। तुम इन दोनों में से किस श्रेणी में आते हो?' माघ अवाक रह गए। तब वृद्धा बोली, 'महाकवि माघ, मैं तुम्हें अच्छी तरह पहचानती हूं। विद्वता के साथ मनुष्य में विनम्रता भी होनी चाहिए। इसलिए अहंकार से दूर रहकर विनम्रता को अपनाओ, तभी श्रेष्ठ विद्वान कहलाओगे।'
